before the Trademark Trial and Appeal Board (Board) against Dream Big Media, Inc.’s trademark application for “Mymobi” (for entertainment services related to the mobile web)...
In its Notice of Opposition, mTLD Top Level Domain Name, Ltd. (whose investors include Ericsson, Google, GSM Association, Hutchison, Microsoft, Nokia, Orascom Telecom, Samsung Electronics, Syniverse, T-Mobile, Telefónica Móviles, TIM, Visa and Vodafone) alleged that it possessed superior trademark rights in the Internet top-level domain name extension, “.Mobi,” and that there would be a likelihood of confusion and dilution of the “.Mobi” mark if the trademark application for “Mymobi” matured into a trademark registration. Dream Big Media, Inc. moved for summary judgment in May, 2008 and argued that the Internet domain name extension, “.Mobi,” could not function as a trademark.
After several grants of extensions of time to oppose Dream Big Media, Inc.’s summary judgment motion, mTLD Top Level Domain, Ltd., without reason, withdrew from the opposition proceedings. The opposition proceeding brought by mTLD Top Level Domain, Ltd. against Dream Big Media, Inc. raised important issues bearing on the new ICANN Internet domain extension policy, which would provide an unlimited number of suffixes such as “.Coke” or “.Sports” to brand owners and Internet entrepreneurs.
