Disney Enterprises,the largest media and entertainment conglomerate in the world has recently won another domain name case,covering five domain names : disneymoviesonline.com, bestdisneymovies.com, newdisneymovies.com, officialdisneymovies.com and thedisneymovies.com .
The company,represented by J. Andrew Coombs,submitted a complaint to the National Arbitration Forum,requesting the disputed domain names to be transferred from the respondent to the complainant.
The company owns many trademark registrations with the United States Patent and Trademark Office for "Disney" mark.
Therefore,they contended in the complaint that the domain names are confusingly similar to its trademark.
Moreover,they contended that the respondent ,John Johnson, registered and used the domain names in bad faith.
"Respondent has offered the <bestdisneymovies.com> and <newdisneymovies.com> domain names for sale on eBay for $3 million. Complainant also alleges that Respondent offered the disputed domain names for sale to Complainant and that Respondent indicated that he was not using the disputed domain names in connection with any online content or commercial venture. Complainant argues that these facts support a finding that Respondent registered the disputed domain names with the primary intent to sell the disputed domain names for profit."
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this proceeding,the Panel ordered that the disputed domain names be transferred from the respondent to the complainant .
