An arbitrator with the National Arbitration Forum has awarded Search-Dell.com domain name to DELL.The company submitted a complaint to the National Arbitration Forum on November 3,asserting legal rights over the disputed domain name.
DELL owns many trademark registrations for the "DELL" mark all over the world.Therefore,it is more than obvious that the disputed domain name confusingly similar to its trademark.Moreover,DELL contended that the respondent registered and used the disputed domain name in bad faith ."Respondent is attempting to attract Internet users to its website for commercial gain. "
"Further, the Panel finds that Respondent’s use of the domain name to redirect Internet users to an adult-oriented website is itself evidence of bad faith registration and use."
The Panel ordered the disputed domain name to be transferred from the respondent to the complainant .
