Davidoff ,a Swiss tobacco goods brand name submitted a complaint with the WIPO Arbitration and Mediation Center requesting the domain names davidoffcigarcutter.com,davidoffhumidor.com and davidoffhumidors.com to be transferred from the respondent to the complainant.

It is well known that Davidoff is a brand ,having many registered trademarks all over the world .That's why the complainant contended that the respondent, Nicaragua Tobacco Imports registered the three disputed domain names even though they knew there are confusingly similar to Davidoff trademark .
Moreover,it seems that the respondent registered and used the domain names in bad faith .
 "Complainant’s allegation of bad faith use is sustained as the site either functions as a portal to other goods, some of which are in direct competition with Complainant, or to facilitating pop-up advertising. Both the functions of the site and the use of the name of the Complainant make clear bad faith on the part of Respondent, both in registration and use."
Because the respondent failed to submit a response to the application and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain names to be transferred from the respondent to the complainant.
