Continental Airlines,an American airline has recently won an arbitration hearing to get contiental.com,coninental.com, and conrinental.com domain names.
The company submitted a complaint to the National Arbitration Forum claiming rights over the three domain names .
Continental Airlines owns many trademark registrations for the "Continental" and "Continental Airlines ".
Therefore,to make the case ,Continental Airlines claimed that the three domain name are confusingly similar to its trademark.Moreover,they contended in the complaint that the respondent registered and used the domain names in bad faith .
"Respondent’s use of Continental’s marks and use of the disputed domain names to offer links to competing travel and airfare sites suggest that Respondent had actual knowledge of Continental’s rights in its marks when Respondent registered contiental.com, coninental.com, and conrinental.com. "
Moreover,the respondent "has been subject to at least seven other UDRP proceedings where it was ordered to transfer domain names to the rightful trademark holders",such as Louis Vuitton,The university of Houston,Association of Tex.,Cirrus System and others.
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the three disputed domain names be transferred from the respondent to the complainant.
