Ulster Bank ,one of the biggest banks from Northern Ireland has recently won a domain name case.
The bank,represented in this case by James A. Thomas submitted a complaint to the National Arbitration Forum,requesting the domain name ulsterbank.mobi to be transferred from the respondent to the complainant.
Ulster Bank is the owner of many trademark registrations for the "Ulster Bank" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent,registered and used the domain name in bad faith.
"Respondent’s disputed domain name resolved to a website that promoted Complainant’s competitors in the financial services industry through click-through links. Since then, Respondent’s disputed domain name has been used to operate a website that attempts to create the impression of being associated with Complainant and offer financial services in direct competition with Complainant. Such activities clearly disrupt Complainant’s business. These uses qualify as bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel decided the disputed domain name to be transferred from the respondent to the complainant.
