Coca Cola Company ,the world's largest beverage company,has recently won a domain name case .
The company filed a complaint with the WIPO Arbitration and Mediation Center ,requesting the domain name cokerewards2009.com to be transferred from the respondent to the complainant.
The complainant owns trademark registrations for the "Coke" trademark in every country in the world.
Therefore,they contended in the complaint that the domain name is confusingly similar to its trademark.Moreover,they contended that the respondent registered and used the disputed domain name in bad faith.
" The Respondent is intentionally using the Domain Name to direct traffic to a web site that solicits personal information by creating confusion as to source and results in commercial gain to the Respondent. The Respondent’s registration and use of the Domain Name in connection with fraudulent attempts to collect personal information by creating the false impression that the site was affiliated with the Complainant is a clear indication of bad faith."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
