Citigroup wins domain name dispute

Citigroup,an American financial services company, has recently won a domain name through arbitration decision .

The company submitted a complaint to the National Arbitration Forum, requesting the domain name citimortgage.net to be transferred from the respondent to the complainant.
But,this isn't an usually domain name case,in which the complainant would have had to demonstrate that the respondent registered and used the domain name in bad faith and that the domain is confusingly similar to its trademark.
It seems that there was a communication between the respondent,Domain Privacy LTD,and the complainant. Therefore, the respondent agreed to transfer the domain name to complainant.
"In this case, the parties have both asked for the domain name to be transferred to the Complainant . . . Since the requests of the parties in this case are identical, the Panel has no scope to do anything other than to recognize the common request, and it has no mandate to make findings of fact or of compliance ."
“Under such circumstances, where Respondent has agreed to comply with Complainant’s request, the Panel felt it to be expedient and judicial to forego the traditional UDRP analysis and order the transfer of the domain names.”
