Cartier,a world famous company,has recently won cartier-eyewear.com and cartier-sunglasses.com domain name in arbitration.
The company filed a complaint with the WIPO Arbitration and Mediation Center,requesting the disputed domain name to be transferred from the respondent to the complainant.
Cartier is the owner of many trademark registrations for the mark "Cartier" all over the world.
Therefor,they contended in the complaint that the disputed domain names are confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain names in bad faith.
"Respondent was using the disputed domain names to attract, for commercial gain, Internet users to its website by creating a likelihood of confusion with the Complainant’s mark."
"Respondent registered the disputed domain names in order to prevent the Complainant from reflecting the CARTIER mark in a corresponding domain name."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain names be transferred from the respondent to the complainant.
