Burberry,a British luxury fashion house,has filed for arbitration to get the burberryscarfshop.com,burberryscarfstore.com domain names.Burberry filed a complaint with the WIPO Arbitration and Mediation Center,requesting the disputed domain names to be transferred from the respondent to the complainant.
The fashion house owns many registered trademarks for the "Burberry" mark.Therefore,the company contended in the complaint that the disputed domain names are confusingly similar to its trademark.
Moreover,they contended that the domain names were registered and used in bad faith .
The Panel decided that the respondent was trying to gain personal profit on the strength of a registered trademark and ruled in favor of Burberry in this case .
