Baylor University wins domain name case

Baylor University,a private, Baptist-affiliated research university located in Waco, Texas submitted a complaint for the domain name baylorcollege.com .

The University is represented in this case by Wendy C. Larson.
In the complaint,the University informs the Panel that they have a various registrations with the USPTO for the "Baylor" service mark.Therefore the believe the respondent had no rights to register the disputed domain name.
A very important issue is also the fact that the respondent used the domain name for a website featuring advertisements for complainant's competitors.
It's no doubt that baylorcollege.com domain name is confusingly with the complainant's mark.The domain name includes Baylor University's entire mark,and even though the term "college" has nothing to do with their mark,it relates to complainant;s business.
Having established all three elements required to be proven,the domain name registered by Respondent is identical or confusingly similar to a trademark or service mark in which Complainant has rights; and  Respondent has no rights or legitimate interests in respect of the domain name; and  the domain name has been registered and is being used in bad faith,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
