Baylor University scores victory in domain name case

Baylor University,a private, Baptist-affiliated research university located in Waco, Texas submitted a complaint to the National Arbitration Forum,requesting the domain name baylormedicalschool.com to be transferred from the respondent to the complainant.

All started when Justin Mitts,which is also the respondent in this case,registered the disputed domain name .
It wouldn't have been such a big problem ,if Baylor University wouldn't have been the owner of of "Baylor University" mark,registered with the United Stated Patent and Trademark Office .
Therefore,the University began the case by demonstrating the disputed domain name is confusingly similar to its "Baylor" mark.
Moreover,they contended that the respondent registered and used the domain name in bad faith.
"Respondent received click-through fees from the third-party hyperlinks previously featured on the website resolving from <baylormedicalschool.com> domain name.  Respondent used the confusingly similar disputed domain name to profit from Internet user’s confusion as to Complainant’s affiliation with the resolving website."
Becasue the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
