Baylor University,a private, Baptist-affiliated research university located in Waco, Texas submitted a complaint to the National Arbitration Forum,requesting the domain name baylorbkstr.com to be transferred from the respondent to the complainant.
All started when Dezider Banga ,which is also the respondent in this case,registered the disputed domain name .
It wouldn't have been such a big problem ,if Baylor University wouldn't have been the owner of of "Baylor University" mark,registered with the United Stated Patent and Trademark Office .
Therefore,the University began the case by demonstrating the disputed domain name is confusingly similar to its "Baylor" mark.
"Respondent is using the disputed domain name to intentionally attract Internet users and profit through the receipt of pay-per-click fees. The Panel finds that Respondent’s use of the disputed domain name is evidence of bad faith."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
