Yahoo owns numerous trademark registrations with the United States Patent and Trademark Office for its Yahoo! mark.Therefore,Yahoo contended that the disputed domain name is confusingly similar to its trademark.Moreover,Yahoo contended that the respondent registered and used the disputed domain name in bad faith :
The domain name "resolved to a website that contained links to other sites that included that of the Complainant’s competitors. The Respondent’s use of the disputed domain name was evidently in an attempt to create confusion to attract Internet users to its website for commercial gain ."
The Panel ordered the disputed domain name be transferred from the respondent to the complainant .
