An Arbitrator with the National Arbitration Forum has awarded the wwwaolnews.com domain name to AOL .A complaint was submitted to the National Arbitration Forum,in which AOL requested the domain name to be transferred from the respondent to the complainant .
The company established rights in the "AOL" mark through its many registrations of the mark all over the world,including with the United States Patent and Trademark Office .
Therefore,AOL contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .\
"Respondent’s <wwwaolnews.com> domain name resolves to a website containing third-party hyperlinks, which in turn resolve to the websites of Complainant’s competitors in the news service business. Thus Internet users interested in Complainant’s new services may instead utilize the new services of a competitor owing to Respondent’s use of a domain name which is confusingly similar to Complainant’s mark."
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this proceeding,the Panel ordered the disputed domain name be transferred from the respondent to the complainant.
