The National Arbitration Forum announced that two rulings have been issued in favor of American Airlines regarding rights to two Internet domain names : AmericanAirlinesRewards.com and AmericanAirlinesJobs.com.
American Airlines,represented in this cases by Leonard Searcy,submitted two complaints to the National Arbitration Forum,asserting legal rights to the disputed domain names.
The company owns multiple trademark registrations for its "American Airlines" mark with the United States Patent and Trademark Office .Therefore,they contended that the disputed domain names were confusingly similar to its trademark.
Moreover,they contended that the repondents registered and used the disputed domain names in bad faith .
"Respondent’s <americanairlinesrewards.com> domain name redirects Internet users to a website which contains links to other websites, including some in direct competition with Complainant’s airline business. "
"Respondent’s <americanairlinesjobs.com> domain name features hyperlinks, some of which resolve to Complainant’s competitors in the airline industry. "
The Panel ordered in both cases the disputed domain names to be transferred from the respondents to the complainant .
