The WIPO Arbitration and Mediation Center announced that a ruling has been issued in favor of Jimmy Choo,regarding rights to three internet domain names : jimmychoooutlets.com,jimmychoooutletstore.com and jimmychooshoesoutlet.com.
Jimmy Choo filed a complaint with the WIPO Arbitration and Mediation Center asserting legal rights over the disputed domain names.Jimmy Choo owns several trademark registrations for the "Jimmy Choo" mark.Therefore,the British high fashion house contended the disputed domain names are confusingly similar to its trademark.
Moreover,the Jimmy Choo contended the respondent registered and used the disputed domain names in bad faith.
"...the disputed domain names are being used to offer for sale unauthorized counterfeit JIMMY CHOO products via the Websites and this contention has not been rebutted by the Respondent. This is strong evidence of bad faith ."
The Panel ordered the disputed domain names to be transferred from the respondent to the complainant.
