The National Arbitration Forum announced that a ruling has been issued in favor of AOL regarding rights to three Internet domain names : aolmusik.com,joytiq.com and mapquert.com.
AOL ,represented in this case by James R.Davis submitted a complaint to the National Arbitration Forum a while ago asserting legal rights to the disputed domain name.
The company owns trademark registration with the United States Patent and Trademark Office for the "AOL.com", "Mapquest.com" and "Joystiq" marks .Therefore,AOL contended the disputed domain names are confusingly similar to its trademark.
Moreover,AOL contended that the respondent registered and used the domain names in bad faith.
"Respondent uses the <aolmusik.com>, <mapquert.com> and <joytiq.com> domain names to compete with Complainant’s business by featuring third-party competitors’ links at each of the three disputed domains. The Panel finds Respondent’s registration and use is a disruption of Complainant’s business and in bad faith."
The Panel ordered the disputed domain names to be transferred from the respondent to the complainant.
