State Farm Mutual Automobile Insurance Company,a mutual insurance firm, has recently won the StateFarmCareerFair.com domain name in arbitration . The mutual insurance firm submitted a complaint to the National Arbitration Forum,requesting the statefarm2save.com domain name to be transferred from the respondent to the complainant.
The complainant owns a service mark registration for the "State Farm" mark with the United States Patent and Trademark Office .Therefore they contended in the complaint that the disputed domain names are confusingly similar to its trademark.
Moreover,they said the disputed domain names were registered and used in bad faith.
"Respondent’s <statefarmcareerfair.com> domain name diverts Internet users seeking Complainant’s products and services to its parked website, which provides links to third-party websites that compete with Complainant. "
"Respondent uses a confusingly similar domain name to profit from the receipt of click-through fees. Accordingly, the Panel finds Respondent has intentionally attempted to attract, for commercial gain, Internet users to its website, by creating a likelihood of confusion with the Complainant’s mark as to the source, sponsorship, affiliation, or endorsement of Respondent’s site. "
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this case,the Panel ordered the disputed domain name be transferred from the respondent to the complainant .
