The National Arbitration Forum announced that a ruling has been issued in favor of State Farm Mutual regarding rights to the internet domain name StateFarmBrookyln.com . State Farm Mutual,represented in this case Debra J. Monke ,submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name.
The company holds trademark registrations for its "State Farm" mark with the United States Patent and Trademark Office .Therefore,they contended the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Complainant asserts that Respondent is not commonly known by the disputed domain name. Complainant further asserts that Respondent has never been known by, or performed business under, the disputed domain name. Complainant also indicates that Respondent does not have any contractual arrangement with Respondent that would allow Respondent to use Complainant’s mark in a domain name."
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
