An arbitrator with National Arbitration Forum has awarded the domain name ruanbing.com to National Westminster Bank.
A complainant was submitted to the National Arbitration Forum,in which Microsoft requested the domain name ruanbing.com to be transferred from the respondent to the complainant.
Microsoft owns many trademark registrations all over the world for the "Bing" mark.Therefore,they contended in the complaint that the disputed domain name is confusingly similar to its trademark.Moreover,the company contended that the respondent registered and used the domain name in bad faith.
"Respondent’s use of the confusingly similar disputed domain name to redirect Internet users seeking Complainant’s products and services to the services of Complainant’s competitors is evidence of bad faith registration and use."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the two domain names to be transferred from the respondent to the complainant.
