AOL ,the American global Internet services and media company,has recently submitted a complaint to the National Arbitration Forum requesting that the IcqShop.us domain name to be transferred from the respondent to the complainant.
The company owns mark registrations with the United States Patent and Trademark Office for the "ICQ" mark.Therefore,they contended in the complain that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent is benefiting commercially from use of Complainant’s ICQ mark. Complainant contends that Respondent sells ICQ numbers on Respondent’s website for as much as $1,000. Further, Complainant argues that Respondent is using Complainant’s mark and logo on its website to create the impression that Respondent is either affiliated with or sponsored by Complainant. "
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this proceeding,the Panel ordered that the domain names be transferred from the respondent to the complainant .
