Arbitrator hands ChenlFans.com to Chanel

WIPO announced that a ruling has been issued in favor of Chaenl regarding rights to the Internet domain name chanelfans.com. Chanel,represented in this case by Fross Zelnick Lehrman & Zissu filed a complaint with the WIPO Arbitration and Mediation Center,asserting legal rights to the disputed domain name. The fashion house owns many registered trademarks for the "Chanel" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.Moreover,they contended that the respondent registered and used the domain name in bad faith .
"The Respondent registered the Disputed Domain Name to attract for commercial gain Internet users by creating a likelihood of confusion with the CHANEL Mark and to induce the public to purchase counterfeit watches. Therefore, the use and registration of the Disputed Domain Name is in opportunistic bad faith."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name be transferred from the respondent to the complainant.
