Arbitrator hands aimexpess.com to AOL

An arbitrator with the National Arbitration Forum has awarded the domain name aimexpess.com to AOL . AOL ,the American global Internet services and media company,started by submitting a complaint to the National Arbitration Forum ,asserting legal rights to the disputed domain name.
The company owns the exclusive rights to use its AIM and AIM EXPRESS marks in connection with various Internet-related services.Therefore,they contended in the complaint that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the domain name in bad faith :
"Respondent uses the <aimexpess.com> domain name to direct Internet users to a commercial site that promotes Complainant’s competitors.  Respondent likely benefits from it use of the misspelling of Complainant’s mark AIM EXPRESS by attracting Internet users for the purpose of Respondent’s own commercial gain."
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
