Apple wins domain name dispute

Apple, the American corporation that manufactures electronics and computer software products has recently won another domain name dispute. The corporation submitted a complaint to the National Arbitration Forum, requesting four domain names, macbookpro.us, macbook.us, macbooks.us, and macpro.us ,to be transferred from the respondent to the complainant.
The complainant owns both "Mac" and " MacBook" mark, regidtered with the United States Patent and Trademark Office.
Therefore, they contended in the complaint that the domain names are confusingly similar to its trademarks.
Moeover, they contended that the respondent,Daniel Bijan, registered and used the domain names in bad faith .
" Respondent is using the disputed domain names to resolve to a website that features links to websites offering products and services in direct competition with Complainant. "
"Respondent’s use of Complainant’s MAC and MACBOOK marks within the disputed domain names creates a likelihood of confusion as to the source and affiliation of Respondent’s website and the disputed domain names.  Further, Respondent is presumed to have sought out commercial benefit through the accrual and receipt of click-through referral fees."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed, the Panel ordered the disputed domain names to be transferred from the respondent to the complainant.
