Apple filed a complaint with the WIPO Arbitration and Mediation Center against Tarik Tolunay,reclaiming sic different domain names.The result gave Apple the rights to all of them .
The company submitted the complaint ,asserting legal rights over the six domain names : appleoslion.com, appleosxlion.com, macoslion.com,macosxleo.com, macosxleon.com and macosxlion.com .
Apple owns many trademark registration for the "Apple" mark,registered with the United States Patent and Trademark Office.Moreover,the company holds other trademark and service mark registration on the Principal Register of the United States Patent and Trademark Office ,such as "MAC" , "MAC OS" , "MAC.COM " and "MACINTOSH" .Therefore,they contended that the disputed domain name are confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain names in bad faith :
"Respondent has offered to sell the disputed domain names for a sum that is clearly in excess of his out of pocket costs."
"Respondent has registered multiple domain names that all incorporate the Complainant’s marks and terms associated with those marks. "
"Respondent has used the disputed domain names to direct traffic to a “click through” or “pay per click” website."
The Panel ordered all six domain names to be transferred from the respondent to the complainant.
