The National Arbitration Forum announced that a ruling has been issued in favor of AOL regarding rights to the Internet domain name Winamp.mobi.AOL,represented in this case by James R. Davis,submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name.
AOL owns trademark registrations for the "Winamp" mark with the United States Patent and Trademark Office and the Chinese State for Industry and Commerce.Therefore,the company contended that the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent is using the disputed domain name to resolve to a website displaying third-party links to competing media player and music applications. This has the effect of diverting customers seeking Complainant’s WINAMP application to the products of Complainant’s competitors, and is therefore evidence of Respondent’s bad faith registration and use of the contested domain name ."
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
