AOL wins seven domain names in Arbitration

An Arbitrator with the National Arbitration Forum has awarded seven domain names to AOL .A complaint was submitted to the National Arbitration Forum,in which AOL requested the domain name to be transferred from the respondent to the complainant . The seven domain names are : findaol.com, aolmailbox.com, aolprofiles.com, musicchannelaol.com, gotoicq.com, icqmessenger.com, and icq2.com .
The company established rights in the "AOL" mark and in the "ICQ" mark through its many registrations of the marks all over the world,including with the United States Patent and Trademark Office .
Therefore,AOL contended in the complaint that the domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent is using the <findaol.com>, <aolmailbox.com>, <aolprofiles.com>, <musicchannelaol.com>, <gotoicq.com>, <icqmessenger.com>, and <icq2.com> domain names to advertise and provide third-party hyperlinks to businesses offering similar Internet-based chat, entertainment, and computer services as Complainant and links to businesses that are unrelated to Complainant. "
Because the complainant managed to demonstrate all the elements needed and because the respondent failed to submit a response in this proceeding,the Panel ordered the disputed domain names be transferred from the respondent to the complainant.
