AOL wins mapquesy.com and mapgues.com domain names in Arbitration

AOL,an American global Internet services and media company has recently won a domain name case. The company submitted a complaint to the National Arbitration Forum,requesting the disputed domain names to be transferred from the respondent to the complainant.
AOL has many registrations with the United States Patent Trademark and Office for the "Mapquest" .Thereforemthe complainant contended that the domain names are confusingly similar to its trademark.
Moreover,the complainant contended that the respondent registered and used the domain names in bad faith.
"Respondent’s registration and use of the disputed domain names to link Internet users to websites featuring third-party links which are in competition with the business of Complainant constitutes disruption of Complainant’s business and therefore evidences bad faith registration and use."
"Respondent’s use of the disputed domain names to attract Internet users attempting to access Complainant’s goods and services and to redirect them to the website resolving from the disputed domain name, presumably profiting from the receipt of click-through fees in the process, is evidence of bad faith."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain names to be transferred from the respondent to the complainant.
