AOL wins aolcom.com domain name in Arbitration

AOL ,the American global Internet services and media company,has recently won a domain name in Arbitration. AOL submitted a complaint to the National Arbitration Forum requesting aolcom.com domain name to be transferred from the respondent to the complainant.
The company owns many trademark registrations all over the world for the "AOL" mark.Therefore,they contended that the disputed domain name is confusingly similar to its trademark.
Moreover,the complainant contended that the respondent registered and used the disputed domain name in bad faith.
"Respondent’s use of the disputed Domain Name to link Internet users to websites that directly compete with Complainant constitutes a disruption of Complainant’s business ."
"Respondent has used and continues to use the Domain Name <aolcom.com> with a commercial website that references AOL and its services, and provides links to AOL's competitors websites. The website is entirely in English and makes no references to medical services or conditions."
However,the respondent,Pavel Panchuk,contended that he purchased and used the domain name in good faith.He added that he used the domain name for explaining medical conditions of Alveolar pulmonary edema and coma.
Other interesting thing is that the respondent owns other domain names that infringe other trademarks,such as amazoncom.com and wwwverizon.com
Therefore,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant.
