The National Arbitration Forum announced that a ruling has been issued in favor of AOL regarding rights to the internet domain name AOL.cc . AOL,represented in this case by James R. Davis ,submitted a complaint to the National Arbitration Forum,asserting legal rights to the disputed domain name.
The company claims rights in the AOL mark through its registrations of the mark with the United States Patent and Trademark Office .Therefore,they contended the disputed domain name is confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent’s <aol.cc> domain name is identical to Complainant’s AOL mark and that Respondent uses the disputed domain name to receive affiliate fees from Complainant. "
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
