Ben Dean ,a businessman lost a UDRP for Deacom.com this month.He owned this domain name since 1997.
Even though he provided the arbitration panel with screenshots of his Gmail Inbox,wanting to prove them he had been using the disputed domain name,The National Arbitration Forum arbitrator,Estella S. Gold seemed to ignore them: “The Panel agrees with Complainant’s assertion that Respondent has not utilized the disputed domain name in an active manner.”
All of that because a company filed a trademark for DEACOM in 2006, claiming first use in commerce in 1995. It decided to file the arbitration case to get the corresponding domain name.
Things would have been much easier if Ben Dean would have had a UDRP lawyer.But it seems like everyone who visited UDRPfail.com is in his favor.
