Lisa Guerrero,filed a complaint with the WIPO Arbitration and Mediation Center ,requesting the domain name lisaguerrero.com to be transferred from the respondent to her .
It's true that she didn't registered her name as a trademark,but it's obvious that her name represents something .Therefore ,she contended that the domain name is confusingly similar to to her name.
Moreover,she contended that the respondent registered and used the domain name in bad faith .
" Respondent was aware of the Complainant’s rights in the LISA GUERRERO trademark; (ii) the Respondent is using a confusingly similar Domain Name in connection with a website to divert Internet users seeking the Complainant’s website to the Respondent’s website, thereby interfering with the Complainant’s business and (iii) the Respondent is using a confusingly similar Domain Name in connection with the operation of a website that trades on the Complainant’s famous reputation and leads Internet users into believing that the Complainant endorses, sponsors or is affiliated with the Respondent."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain name to be transferred from the respondent to the complainant .
