The National Arbitration Forum announced that a ruling has been issued in favor of American Airlines regarding rights to the Internet domain name AmericanMiles.com .
American Airlines owns many trademark registration for the "American Airlines" mark with the United States Patent and Trademark Office.Therefore,they contended the disputed domain name is confusingly similar to its trademark.Moreover,they contended that the respondent registered and used the disputed domain name in bad faith .
"Respondent registered the disputed domain name for the primary purpose of intentionally attempting to attract, for commercial gain, Internet users to Respondent’s website by creating a likelihood of confusion with Complainant’s AMERICAN AIRLINES mark as to the source, sponsorship, affiliation or endorsement of Respondent’s disputed domain name, resolving website, or product or service advertised on Respondent’s website. "
The Panel ordered the disputed domain name be transferred from the respondent to the complainant.
