American Automobile Association,also known as AAA,has recently been awarded the domain name aaaautoinsurance.com.
The company filed a complaint to WIPO Arbitration and Mediation Center,requesting the disputed domain name,aaaautoinsurance.com to be transferred from the respondent to the complainant.
The American Automobile Association registered the "AAA" mark with the United States Patent and Trademark Office.Therefore they are accusing the respondent that they have registered a domain name confusingly similar to its trademark.
Moreover,the respondent is accused of registering and using the domain name in bad faith.
"Respondent appears to have intended to use the Disputed Domain Name to promote products based upon the confusing similarity between the Complainant’s AAA marks and the Respondent’s <aaaautoinsurance.com> web site. Moreover, the Respondent appears to have renewed the Disputed Domain Name’s registration just three months after receiving the second cease and desist letter from the Complainant."
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered that the disputed domain name aaaautoinsurance.com be transferred from the respondent to the complainant.
