The American Automobile Association,also known as AAA,has recently won wwwaaa4insurance.com and aaa4insurace.com domain names through arbitration.
AAA submitted a complaint to the National Arbitration Forum,requesting the disputed domain names to be transferred from the respondent to the complainant.
The American Automobile Association registered the "AAA" mark with the United States Patent and Trademark Office.Therefore,they contended in the complaint that the disputed domain names are confusingly similar to its trademark.
Moreover,they contended that the respondent registered and used the disputed domain names in bad faith.
"Respondent is using the <wwwaaa4insurance.com> and <aaa4insurace.com> domain names to intentionally divert Internet users to Respondent’s website that displays third party links to competing businesses and websites. In this case the Panel presumes that Respondent is collecting click-through fees and is attempting to profit by creating a likelihood of confusion between the Complainant’s AAA mark and the confusingly similar disputed domain names. "
Because the respondent failed to submit a response in this proceeding and because the complainant managed to demonstrate all the elements needed,the Panel ordered the disputed domain names be transferred from the respondent to the complainant.
